Alec Baldwin faces 18 months in prison on new charges in 'Rust' shooting case

Alec Baldwin has been formally charged with manslaughter for the second time, and this could mean prison.

New documents released by New Mexico prosecutors confirm the team is seeking to hold Alec responsible for the death on the set of Oxide the young director of photography, Halyna Hutchins.

“The above defendant caused the death of Halyna Hutchins through an act committed with complete disregard and indifference to the safety of others,” the indictment reads in part.

Baldwin was initially charged in the case in January 2023.

However, the charges were dropped three months later. His defense team insisted there was evidence to suggest the Colt .45 he was holding at the scene was not working properly.

The young cinematographer was preparing to film a scene with Baldwin on a ranch near Santa Fe, New Mexico, in October 2021 when the gun went off.

Alec has insisted he did not pull the trigger, but if convicted he faces a prison sentence of up to 18 months.

Alec did not immediately respond to the new accusation. Instead, his lawyers issued this statement:

“We look forward to our day in court,” said Luke Nikas and Alex Spiro, his attorneys.

Why was he charged twice?

New Mexico prosecutors initially dropped the criminal case against Alec last summer to review new evidence.

It had been suggested that the weapon he was carrying had been modified.

After a five-month investigation and a categorical confession by Alec that he never pulled the trigger, a forensic expert insisted that his evidence showed that the gun could not have been fired any other way.

“This fatal incident was the consequence of the hammer being manually retracted to its fully rearward position and cocked, followed, at some point, by squeezing or pulling back the trigger,” the report reads in part.

“Although Alec Baldwin repeatedly denies pulling the trigger, given the evidence, findings and observations reported here, the trigger had to be pulled or depressed enough to release the fully cocked or retracted hammer from the test revolver.”
